20 community leaders from Lanao Sur attend dispute resolution training

A four-day training on Alternative Dispute Resolution for 20 participants from community-based partners of Maranao People’s Development Center (Maradeca Inc). and UNYPAD-Ranao cluster was conducted on October 27-31, 2018 at Minkay Midway, Initao, Misamis Oriental.

The resource persons were Rachel Aquino, Luz Divina C. Anung, and Alim Ibrahim A. Bagumbun. These trainers are from Mediators Network Sustainable Peace and Incorporated (MedNet Inc) aiming to empower dispute resolution management process (EDRMP) through non-government organizations, peoples organizations, and the government.

“This is a project of the Office of the Presidential Adviser on the Peace Process (OPAPP) and the United Nation Development Program (UNDP) under its Support to Peace Building and Normalization Welfare Assistance Vulnerable Sector (SPAN-WAVE) which seeks  to support the normalization phase of the GPH-MILF peace agreement implementation. Under the normalization process we wanted to reintroduce Alternative Dispute Resolution (ADR) for out of court settlement of conflicts,” explained Aquino.

The training extensively discussed conflict, its nature and dynamics, the six diagnostic tools of conflict, conflict mapping, force field analysis, and analysis of functional ingredients of conflict or dispute resolution.

Participants had their exercises, role playing, discourses on mediation, active listening, probing, feedback giving, and non-violent communication.

During the workshop, participants analyzed conflicts arising from land conflict, election-related disputes, and concerns on access to humanitarian assistance.

Anung discussed the circles of conflict, sources of power, and stakeholders analysis to substantiate the conflict diagnostic tools and to to diagnose and understand the facts about conflict from different perspectives.

Alim Ibrahim A. Bagumbun, on the other hand, talked about the Islamic perspective on alternative dispute resolution.

Bagumbun cited the principles of sulh (through negotiation, mediation/conciliation, and compromise of action); tahkim (arbitration); med-arb (a combination of sulh and tahkim) in Islam as tools of conflict mediation.

“Sulh or can be read as sulah or “to cut off a dispute‟ or “to finish a dispute‟ either directly or with the help of a neutral third party and that sulh is the best solution,” he said.

Bagumbun emphasizes that sulh includes mediation, negotiation, conciliation and such other words of similar nature but not litigation.

A participant of the alternative dispute resolution training presented the group problem tree analysis of a conflict they sought to resolve in a workshop.

“Its main purpose is to end conflict and hostility among the disputants so that they may conduct their relationships in peace and amity without any further interference from the court,” he explained.

“The holy Qur’an encouraged Alternative Dispute Resolution in An-Nisaa:114 which stated: “in most of their secret talks there is no good; but if one exhorts to a deed of charity or justice or conciliation between men, (secrecy is permissible): to him who does this, seeking the pleasure of Allah, We shall soon give a reward of the highest (value),” he pointed

“There is hadith or authenticated book by Sahih Al Bukhari said, “he, who makes peace (Sulh) between the people by inventing good information or saying good things, is not liar,” he added.

This training was co-facilitated by Norliah B. Deron, Maradeca’s project coordinator, and Johara U. Macadatar from UNYPAD-Ranao).

Abdul Fahad Liwalug, community development facilitator of Maradeca Inc., said that one of the consequence of this training was conduct of community-based conflict mapping and to document of these identified community conflict are already resolved.
